SC makes written communication of arrest grounds mandatory for all offences / ਸੁਪਰੀਮ ਕੋਰਟ ਨੇ ਸਾਰੇ ਅਪਰਾਧਾਂ ਲਈ ਗ੍ਰਿਫਤਾਰੀ ਦੇ ਮੈਦਾਨਾਂ ਬਾਰੇ ਲਿਖਤੀ ਸੰਚਾਰ ਲਾਜ਼ਮੀ ਕੀਤਾ
- Supreme Court of India has made it mandatory for the police and other investigating agencies to provide the grounds (reasons) for arrest in writing to the arrested person.
- This is considered a fundamental and mandatory safeguard under Article 22(1) of the Constitution.
- The requirement applies to all arrests, regardless of the nature of the offense or the specific law (e.g., Indian Penal Code/Bharatiya Nyaya Sanhita, UAPA, PMLA) under which the arrest is made.
- The Court has emphasized that merely informing the grounds orally is insufficient because an arrested person may not be in a proper frame of mind to remember the details.
- This judgment builds on earlier landmark cases like D.K. Basu v. State of West Bengal (1997) and Pankaj Bansal v. Union of India (2023), which established comprehensive guidelines to prevent custodial abuse and ensure transparency in arrest procedures.
- ਸੁਪਰੀਮ ਕੋਰਟ ਨੇ ਪੁਲਿਸ ਅਤੇ ਹੋਰ ਜਾਂਚ ਏਜੰਸੀਆਂ ਨੂੰ ਗ੍ਰਿਫਤਾਰ ਕੀਤੇ ਗਏ ਵਿਅਕਤੀ ਨੂੰ ਲਿਖਤੀ ਰੂਪ ਵਿੱਚ ਗ੍ਰਿਫਤਾਰੀ ਦੇ ਆਧਾਰ (ਕਾਰਨ) ਪ੍ਰਦਾਨ ਕਰਨਾ ਲਾਜ਼ਮੀ ਕਰ ਦਿੱਤਾ ਹੈ।
- ਸੰਵਿਧਾਨ ਦੀ ਧਾਰਾ 22 (1) ਦੇ ਤਹਿਤ ਇਸ ਨੂੰ ਇਕ ਬੁਨਿਆਦੀ ਅਤੇ ਲਾਜ਼ਮੀ ਸੁਰੱਖਿਆ ਮੰਨਿਆ ਜਾਂਦਾ ਹੈ।
- ਇਹ ਲੋੜ ਸਾਰੀਆਂ ਗ੍ਰਿਫਤਾਰੀਆਂ 'ਤੇ ਲਾਗੂ ਹੁੰਦੀ ਹੈ, ਚਾਹੇ ਅਪਰਾਧ ਦੀ ਪ੍ਰਕਿਰਤੀ ਜਾਂ ਵਿਸ਼ੇਸ਼ ਕਾਨੂੰਨ (ਉਦਾਹਰਨ ਲਈ, ਭਾਰਤੀ ਦੰਡ ਸੰਹਿਤਾ/ਭਾਰਤੀ ਨਿਆਇ ਸੰਹਿਤਾ, ਯੂਏਪੀਏ, ਪੀਐਮਐਲਏ) ਜਿਸ ਦੇ ਤਹਿਤ ਗ੍ਰਿਫਤਾਰੀ ਕੀਤੀ ਜਾਂਦੀ ਹੈ।
- ਅਦਾਲਤ ਨੇ ਜ਼ੋਰ ਦੇ ਕੇ ਕਿਹਾ ਹੈ ਕਿ ਸਿਰਫ ਜ਼ੁਬਾਨੀ ਅਧਾਰ ਨੂੰ ਸੂਚਿਤ ਕਰਨਾ ਨਾਕਾਫ਼ੀ ਹੈ ਕਿਉਂਕਿ ਇੱਕ ਗ੍ਰਿਫਤਾਰ ਵਿਅਕਤੀ ਵੇਰਵਿਆਂ ਨੂੰ ਯਾਦ ਰੱਖਣ ਲਈ ਸਹੀ ਦਿਮਾਗ ਵਿੱਚ ਨਹੀਂ ਹੋ ਸਕਦਾ।
- ਇਹ ਲੋੜ ਸਾਰੀਆਂ ਗ੍ਰਿਫਤਾਰੀਆਂ 'ਤੇ ਲਾਗੂ ਹੁੰਦੀ ਹੈ, ਚਾਹੇ ਅਪਰਾਧ ਦੀ ਪ੍ਰਕਿਰਤੀ ਜਾਂ ਵਿਸ਼ੇਸ਼ ਕਾਨੂੰਨ (ਉਦਾਹਰਨ ਲਈ, ਭਾਰਤੀ ਦੰਡ ਸੰਹਿਤਾ/ਭਾਰਤੀ ਨਿਆਇ ਸੰਹਿਤਾ, ਯੂਏਪੀਏ, ਪੀਐਮਐਲਏ) ਜਿਸ ਦੇ ਤਹਿਤ ਗ੍ਰਿਫਤਾਰੀ ਕੀਤੀ ਜਾਂਦੀ ਹੈ।
- ਅਦਾਲਤ ਨੇ ਜ਼ੋਰ ਦੇ ਕੇ ਕਿਹਾ ਹੈ ਕਿ ਸਿਰਫ ਜ਼ੁਬਾਨੀ ਅਧਾਰ ਨੂੰ ਸੂਚਿਤ ਕਰਨਾ ਨਾਕਾਫ਼ੀ ਹੈ ਕਿਉਂਕਿ ਇੱਕ ਗ੍ਰਿਫਤਾਰ ਵਿਅਕਤੀ ਵੇਰਵਿਆਂ ਨੂੰ ਯਾਦ ਰੱਖਣ ਲਈ ਸਹੀ ਦਿਮਾਗ ਵਿੱਚ ਨਹੀਂ ਹੋ ਸਕਦਾ।
