Constitution 131st Amendment Bill 2025 / ਸੰਵਿਧਾਨ 131ਵਾਂ ਸੋਧ ਬਿੱਲ 2025
- ØThe Union Home Ministry clarified that the Central Government is not planning to introduce the Constitution (131st Amendment) Bill, 2025 in the Winter Session to bring Chandigarh under Article 240.
- ØBrings Chandigarh under Article 240: Grouping it with UTs where the President can directly frame regulations.
- ØArticle 240 Empowers the President to frame regulations for certain UTs – Andaman & Nicobar Islands, Lakshadweep, Dadra & Nagar Haveli and Daman & Diu, Puducherry (when Assembly is dissolved/suspended).
- Allows independent Administrator: May replace the system where Punjab’s Governor acts as Chandigarh’s Administrator.
- Reduces Punjab’s role: Alters the 1966 Punjab Reorganisation arrangement, raising political concerns.
- Punjab’s current position: Views Chandigarh as its undisputed rightful capital. Asserts that the city was built by “uprooting Punjabi villages”.
- ਕੇਂਦਰੀ ਗ੍ਰਹਿ ਮੰਤਰਾਲੇ ਨੇ ਸਪੱਸ਼ਟ ਕੀਤਾ ਕਿ ਕੇਂਦਰ ਸਰਕਾਰ ਸਰਦ ਰੁੱਤ ਸੈਸ਼ਨ ਵਿੱਚ ਚੰਡੀਗੜ੍ਹ ਨੂੰ ਧਾਰਾ 240 ਦੇ ਅਧੀਨ ਲਿਆਉਣ ਲਈ ਸੰਵਿਧਾਨ (131ਵਾਂ ਸੋਧ) ਬਿੱਲ, 2025 ਪੇਸ਼ ਕਰਨ ਦੀ ਯੋਜਨਾ ਨਹੀਂ ਬਣਾ ਰਹੀ ਹੈ।
- ਚੰਡੀਗੜ੍ਹ ਨੂੰ ਧਾਰਾ 240 ਦੇ ਅਧੀਨ ਲਿਆਉਂਦਾ ਹੈ: ਇਸਨੂੰ ਕੇਂਦਰ ਸ਼ਾਸਤ ਪ੍ਰਦੇਸ਼ਾਂ ਨਾਲ ਸਮੂਹਬੱਧ ਕਰਨਾ ਜਿੱਥੇ ਰਾਸ਼ਟਰਪਤੀ ਸਿੱਧੇ ਤੌਰ 'ਤੇ ਨਿਯਮ ਬਣਾ ਸਕਦੇ ਹਨ।
- ਧਾਰਾ 240 ਰਾਸ਼ਟਰਪਤੀ ਨੂੰ ਕੁਝ ਕੇਂਦਰ ਸ਼ਾਸਤ ਪ੍ਰਦੇਸ਼ਾਂ - ਅੰਡੇਮਾਨ ਅਤੇ ਨਿਕੋਬਾਰ ਟਾਪੂ, ਲਕਸ਼ਦੀਪ, ਦਾਦਰਾ ਅਤੇ ਨਗਰ ਹਵੇਲੀ ਅਤੇ ਦਮਨ ਅਤੇ ਦੀਉ, ਪੁਡੂਚੇਰੀ (ਜਦੋਂ ਵਿਧਾਨ ਸਭਾ ਭੰਗ/ਮੁਅੱਤਲ ਕੀਤੀ ਜਾਂਦੀ ਹੈ) ਲਈ ਨਿਯਮ ਬਣਾਉਣ ਦਾ ਅਧਿਕਾਰ ਦਿੰਦੀ ਹੈ।
- ਸੁਤੰਤਰ ਪ੍ਰਸ਼ਾਸਕ ਦੀ ਆਗਿਆ ਦਿੰਦੀ ਹੈ: ਉਸ ਪ੍ਰਣਾਲੀ ਨੂੰ ਬਦਲ ਸਕਦੀ ਹੈ ਜਿੱਥੇ ਪੰਜਾਬ ਦਾ ਰਾਜਪਾਲ ਚੰਡੀਗੜ੍ਹ ਦੇ ਪ੍ਰਸ਼ਾਸਕ ਵਜੋਂ ਕੰਮ ਕਰਦਾ ਹੈ।
- ਪੰਜਾਬ ਦੀ ਭੂਮਿਕਾ ਨੂੰ ਘਟਾਉਂਦਾ ਹੈ: 1966 ਦੇ ਪੰਜਾਬ ਪੁਨਰਗਠਨ ਪ੍ਰਬੰਧ ਨੂੰ ਬਦਲਦਾ ਹੈ, ਜਿਸ ਨਾਲ ਰਾਜਨੀਤਿਕ ਚਿੰਤਾਵਾਂ ਵਧਦੀਆਂ ਹਨ।
- ਪੰਜਾਬ ਦੀ ਮੌਜੂਦਾ ਸਥਿਤੀ: ਚੰਡੀਗੜ੍ਹ ਨੂੰ ਆਪਣੀ ਨਿਰਵਿਵਾਦ ਜਾਇਜ਼ ਰਾਜਧਾਨੀ ਵਜੋਂ ਦੇਖਦਾ ਹੈ। ਦਾਅਵਾ ਕਰਦਾ ਹੈ ਕਿ ਇਹ ਸ਼ਹਿਰ "ਪੰਜਾਬੀ ਪਿੰਡਾਂ ਨੂੰ ਉਖਾੜ ਕੇ" ਬਣਾਇਆ ਗਿਆ ਸੀ।
